JAS SNUS (Pty) Ltd (“JAS”) is a private body as defined in PAIA, trading as an online retailer of nicotine pouch products in South Africa.

4. Records available in terms of other legislation (section 51(1)(b)(ii))

Records are kept in accordance with legislation including, where applicable: Companies Act 71 of 2008; Income Tax Act 58 of 1962; Value-Added Tax Act 89 of 1991; Basic Conditions of Employment Act 75 of 1997; Labour Relations Act 66 of 1995; Unemployment Insurance Act 63 of 2001; Compensation for Occupational Injuries and Diseases Act 130 of 1993; Consumer Protection Act 68 of 2008; Electronic Communications and Transactions Act 25 of 2002; Protection of Personal Information Act 4 of 2013.

5. Categories of records held (section 51(1)(b)(iii))

Company records: incorporation documents, share register, shareholder and director records, resolutions, agreements. Financial records: annual financial statements, accounting records, banking records, invoices, tax records. Employee records: employment contracts, payroll, leave, disciplinary records. Customer records: account details, order history, delivery details, age verification status, marketing consents, correspondence. Supplier and partner records: contracts and correspondence with suppliers, the fulfilment warehouse, couriers, agencies, and service providers. Operational and marketing records: website content, marketing materials, campaign records, social media records.

Listing a category here does not mean records in that category will be released; requests are assessed under PAIA, and grounds for refusal (such as privacy of third parties, commercial confidentiality, or legal privilege) may apply.

6. Processing of personal information (POPIA)

Purpose of processing: processing and delivering orders; verifying customers’ age as required for the sale of nicotine products; managing customer accounts; payments and refunds; marketing to persons who have consented; complying with legal obligations; and operating and protecting our business.

Categories of data subjects and personal information: - Customers: name, contact details, delivery address, order history, payment references (not card numbers), age verification status, marketing preferences. - Employees: employment and payroll information. - Suppliers and partners: business contact and contract information.

Recipients of personal information: our e-commerce platform, payment processors, age verification provider, fulfilment warehouse, couriers, communications platforms, and professional advisers, all under appropriate contractual safeguards.

Cross-border transfers: some service providers (e.g. our e-commerce platform and age verification provider) store data outside South Africa. Transfers take place in accordance with section 72 of POPIA.

Security measures: we apply reasonable technical and organisational measures, including access controls, encrypted transmission, reputable hosted platforms, and restriction of access to personal information to those who need it.

7. How to request access to records

  1. Complete Form 2 (Request for Access to Record), available from the Information Regulator’s website.
  2. Submit it to the Information Officer at info@jas-snus.co.za, with proof of identity.
  3. Pay the prescribed request fee where applicable.
  4. We will respond within 30 days as required by PAIA, either granting access (on payment of any prescribed access fees) or refusing with reasons.

If a request is refused, the requester may lodge a complaint with the Information Regulator or apply to court.
